Hey-Traders Terms of Service

Alpha Risk Disclosure: Hey-Traders is alpha-stage experimental software for trading research, backtesting, signal monitoring, and user-configured automated execution. Digital assets and cryptocurrency derivatives carry substantial risk of loss and are not appropriate for all users. Use the Service only at your own discretion and risk.
The Service is provided on an "as is" and "as available" basis without warranties of any kind. Technical vulnerabilities, network delays, exchange API errors, wallet or smart-contract issues, slippage, liquidation, failed execution, duplicated execution, and uncertainties related to AI-driven automated execution may cause financial loss.
1. Acceptance of Terms
These Terms govern access to and use of Hey-Traders, including the website, documentation, APIs, AI-assisted strategy tools, backtesting tools, market data views, signal features, and trading automation interfaces (the "Service"). By accessing or using the Service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.
For the alpha period, "Hey-Traders," "we," "us," or "our" refers to the Hey-Traders development team and any successor operating entity that may later assume the Service.
2. Alpha and Experimental Software
- The Service is pre-release experimental software and may contain bugs, incomplete features, incorrect data, unstable integrations, and security vulnerabilities.
- Alpha features may be changed, limited, suspended, or withdrawn at any time without prior notice.
- The Service is not subject to any uptime, support, execution, latency, data-accuracy, or service-level commitment.
- You should use isolated wallets, conservative position sizing, read-only or restricted API keys where possible, and only capital you can afford to lose.
3. Eligibility and Restricted Jurisdictions
- You must be legally capable of entering into these Terms and at least 18 years old, or the age of majority in your jurisdiction if higher.
- The Service is not offered to persons located in, ordinarily resident in, or accessing the Service from jurisdictions where use of the Service would be unlawful or would require registration, licensing, authorization, or approval that we do not hold.
- Prediction market and Polymarket restrictions. Polymarket, prediction-market, event-contract, binary-outcome, and related automated order features are not offered to, and must not be used by, any person or entity that is located in, ordinarily resident in, incorporated in, or principally based in a jurisdiction where such use is prohibited, restricted, blocked, or would require registration, licensing, authorization, or approval that Hey-Traders or the relevant third-party venue does not hold. The same restriction applies if the laws applicable to your citizenship, nationality, residence, incorporation, principal place of business, or place of access prohibit or restrict such use.
- Without limiting the above, you must not use Hey-Traders to place, route, manage, automate, or attempt any Polymarket order if you are subject to Polymarket's restricted-jurisdiction rules, sanctions restrictions, or any local restriction on prediction markets, online gambling, event contracts, binary options, crypto-settled trading, or automated order routing. Restricted jurisdictions may include jurisdictions restricted by Polymarket, OFAC-sanctioned jurisdictions, and jurisdictions where competent regulators have blocked or determined Polymarket or comparable prediction-market services to be unauthorized.
- You are responsible for checking and complying with Polymarket's terms, geographic restrictions, and all laws applicable to you before connecting any Polymarket account, wallet, API credential, or placing any order through the Service. You must immediately stop using Polymarket-related features if you become a restricted person or if your use becomes unlawful.
- Without limiting the above, the Service is not directed to the Republic of Korea, and persons located in or ordinarily resident in the Republic of Korea must not use the Service unless and until a compliant local offering is expressly made available.
- You must not use VPNs, proxies, false information, or other methods to evade jurisdiction, sanctions, eligibility, or access controls.
- You are solely responsible for determining whether your use of the Service is lawful in your jurisdiction.
4. Non-Custodial Software Interface
- Hey-Traders is a software interface. We do not custody, hold, safeguard, or manage user assets, fiat currency, virtual assets, private keys, seed phrases, or exchange accounts.
- Transactions, orders, transfers, and strategy actions are executed through accounts, wallets, APIs, exchanges, protocols, brokers, or other third-party services that you connect or authorize.
- You remain solely responsible for your wallets, exchange accounts, API keys, permissions, private keys, credentials, balances, positions, orders, and risk settings.
- We are not responsible for unauthorized access, account compromise, wallet compromise, exchange failure, protocol failure, or loss of assets caused by your credentials, connected accounts, or third-party services.
5. No Financial, Investment, Legal, or Tax Advice
- The Service, including AI-generated text, code, strategy scripts, backtest results, signals, market data, charts, and documentation, is provided for informational and software-tooling purposes only.
- Nothing in the Service is financial, investment, trading, legal, tax, accounting, or regulatory advice.
- We do not recommend any asset, market, venue, strategy, order, leverage level, position size, or transaction.
- You are solely responsible for independent due diligence and for all decisions, configurations, trades, losses, taxes, and compliance obligations arising from your use of the Service.
- Historical performance, simulations, backtests, examples, generated scripts, and community strategies do not guarantee future results.
6. Trading and Execution Risks
- Digital asset and derivatives markets are volatile and may result in total loss of capital.
- Leveraged, margin, perpetual, or futures trading may create liquidation risk and losses greater than expected.
- Automated execution may fail, delay, duplicate, partially fill, fill at unexpected prices, or execute in a way that does not match your expectations.
- AI-generated or user-generated code may contain logical errors, unsafe assumptions, or unintended behavior.
- Smart contracts, wallets, bridges, exchange APIs, blockchains, RPC providers, market-data feeds, and third-party infrastructure may be exploited, unavailable, delayed, censored, inaccurate, or discontinued.
- You accept all risks associated with latency, slippage, spread, funding rates, fees, liquidity, market manipulation, oracle errors, delistings, forks, governance actions, and regulatory changes.
7. Third-Party Services
- The Service may integrate with authentication providers, cloud providers, analytics tools, AI providers, market-data providers, exchanges, wallets, payment processors, communication tools, and blockchain infrastructure.
- Third-party services are governed by their own terms and privacy policies. You are responsible for reviewing and complying with them.
- Polymarket is a third-party venue and is not operated by Hey-Traders. Polymarket markets, accounts, wallets, orders, settlement, geographic restrictions, and compliance requirements are governed by Polymarket's own terms and applicable law. Hey-Traders does not represent that Polymarket access or trading is lawful for any particular user or jurisdiction.
- We do not control and are not responsible for the content, security, performance, availability, compliance, fees, or actions of third-party services.
- You are responsible for all third-party fees, exchange fees, gas fees, funding costs, network fees, taxes, and other costs arising from your use.
8. User Obligations
- You must provide accurate information and maintain the security of your account, devices, wallets, credentials, and API keys.
- You must not use the Service for money laundering, sanctions evasion, market manipulation, fraud, unauthorized access, illegal gambling, prohibited financial activity, or any unlawful purpose.
- You must not reverse engineer, scrape non-public data, attack, overload, bypass access controls, or interfere with the Service.
- You must immediately stop using the Service if your use becomes unlawful or if you are no longer eligible under these Terms.
9. Data and Privacy
- Our handling of personal information, logs, credentials metadata, connected-account metadata, and other data is described in the Privacy Policy.
- You authorize us to process and transmit data as necessary to provide user-requested features, including sending encrypted or secured API requests to connected exchanges, wallets, market-data providers, and other third-party services.
- You are responsible for ensuring you have the rights and permissions required to submit data, connect accounts, and authorize actions through the Service.
10. Intellectual Property
- The Service, software, interface, documentation, branding, and related content are owned by Hey-Traders or its licensors.
- You retain ownership of your own trading strategies, prompts, and user-generated content, subject to the rights needed for us to operate and improve the Service.
- You may not copy, resell, sublicense, or create competing services from non-public parts of the Service without prior written permission.
11. Suspension and Termination
- We may suspend, restrict, or terminate access to the Service at any time for security, legal, regulatory, operational, risk, abuse-prevention, or Terms-enforcement reasons.
- We may refuse service to any person, wallet, account, region, or integration where we determine that providing the Service creates unacceptable legal, security, operational, or reputational risk.
12. Disclaimers
- To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise.
- We disclaim all warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, error-free operation, accuracy, availability, security, and freedom from malware or vulnerabilities.
- No information, content, code, documentation, support communication, or AI-generated output creates any warranty or advisory relationship.
13. Limitation of Liability
- To the maximum extent permitted by applicable law, Hey-Traders, the development team, contributors, service providers, licensors, and any successor entity will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or similar damages.
- We are not liable for trading losses, liquidation losses, lost profits, lost opportunities, lost data, business interruption, inaccurate data, failed execution, delayed execution, third-party outages, exchange or wallet compromise, protocol exploits, smart-contract failures, or events beyond our reasonable control.
- To the maximum extent permitted by applicable law, our total aggregate liability for all claims relating to the Service will not exceed USD 100 or the amount you paid directly to us for the Service in the three months before the event giving rise to the claim, whichever is greater.
- Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, liability is limited to the fullest extent permitted by law.
14. Indemnification
You agree to indemnify and hold harmless Hey-Traders, the development team, contributors, service providers, licensors, and any successor entity from claims, losses, damages, liabilities, penalties, fines, costs, and expenses arising out of or related to your use of the Service, your connected accounts, your data, your configurations, your breach of these Terms, your violation of law, or your interaction with third-party services.
15. Governing Law and Disputes
- Unless a separate written agreement or successor operating-entity terms state otherwise, these Terms are governed by the laws of the Republic of Panama, without regard to conflict-of-law rules.
- The parties will first attempt to resolve disputes informally by contacting [email protected].
- Where arbitration or forum-selection terms are later adopted by a successor operating entity, continued use after notice may be conditioned on accepting those updated terms.
16. Changes to These Terms
We may update these Terms from time to time. Updates become effective when posted unless a later effective date is stated. Continued use after an update means you accept the updated Terms.
